Quick Answer
Professional Liability (also called Errors & Omissions or E&O) covers California contractors against claims arising from professional services — design work, specifications, consulting, or any advice you give. Standard GL excludes professional errors. If you do design-build, engineering, or any work where a mistake in your specifications could cause loss, you need E&O. Cost depends on the business and underwriting factors: pricing varies by classification, payroll, operations, claims history, limits, and underwriting/year for a small contractor. Who Actually Needs E&O
Most pure builders don't need E&O — they execute someone else's plans. You need E&O if you:
- Provide design-build services
- Stamp engineering drawings
- Specify materials or methods (e.g., HVAC load calcs, solar system sizing)
- Consult for clients before construction
- Hold professional licenses beyond CSLB (PE, architect, etc.)
C-10 electricians doing system design, C-20 HVAC contractors sizing equipment, C-46 solar contractors specifying systems, and any design-build GC commonly need E&O.
What E&O Covers
- Design errors and omissions
- Negligent specifications
- Failure to warn or advise
- Breach of professional duty
- Defense costs even if the claim is baseless
What It Doesn't Cover
- Bodily injury (that's GL)
- Property damage from physical operations (that's GL)
- Intentional acts
- Known prior claims
How Premium Is Priced
| Annual revenue | Typical E&O annual premium |
|---|---|
| Under $250K | pricing varies by classification, payroll, operations, claims history, limits, and underwriting |
| $250K – $1M | pricing varies by classification, payroll, operations, claims history, limits, and underwriting |
| $1M – $5M | pricing varies by classification, payroll, operations, claims history, limits, and underwriting |
| $5M+ | Custom underwriting |

Claims-Made vs Occurrence Form
Most contractor E&O is written on a claims-made form — coverage applies only if the claim is reported during the policy period. If you cancel without buying "tail" coverage, claims that surface later are uncovered. Always discuss tail coverage at renewal.
